What is "title abuse" ?


Since 1993, the title of psychologist is protected in Belgium. The protection of the title of psychologist has two main objectives: 


  • Protect the profession: ensuring that no one can use the title of psychologist without complying with legal requirements.

  • Protect the patients/clients: providing them with the assurance that they are being treated by a qualified professional, authorized to bear the title of psychologist.

Any professional who wishes to use the title of psychologist (or a composite title) must therefore be registered with the Commission of Psychologists. If a professional uses the title of psychologist without holding the required diploma and without being registered with the Commission, they are committing what we call "title abuse". Misusing a title that one is not legally entitled to hold is deceptive both to the profession and to patients/clients.


De plus, un professionnel qui utilise le titre de psychologue sans être inscrit à la ComPsy n’est légalement pas tenu de respecter le Code de déontologie des psychologues. En cas de faute déontologique commise par ce professionnel, le patient/client ne peut introduire une plainte devant les instances disciplinaires de la Commission ou demander une médiation.


Is Title Abuse Punishable?


Yes, since the 1993 law states that title abuse constitutes a criminal offense. Any professional committing title abuse can be prosecuted and, if convicted, faces a fine and the recording of this offense in their criminal record.


It is also important to note that merely using a misleading distinctive sign suggesting the right to use the title of psychologist (without actually using the title) and without holding the required diploma to register with ComPsy is also subject to criminal prosecution.


Furthermore, facilitating title misuse is also punishable, and anyone who intentionally helps, encourages, or allows another person to unlawfully assume the title of psychologist may be subject to prosecution.


What Does The Commission Do in Case of Title Abuse?


The Commission's mission is to protect both the profession of psychologist and patients/clients. In the event of title abuse, the Commission initiates steps with the professional in question to regularize their situation. If they fail to do so, the Commisison may take legal action.


What to do if You Notice a Professional Abusing The Title?
